1. Introductory Provisions

1.1 These terms and conditions (hereinafter "Terms and Conditions") govern the mutual rights and obligations of the contracting parties in connection with or on the basis of a purchase agreement (hereinafter "Purchase Agreement") concluded between the Seller and a natural person (hereinafter "Buyer") via the Seller's online store on the website www.cistapohovka.cz. The online store is operated via the web interface (hereinafter "Web Store Interface").

1.2 These Terms and Conditions do not apply if the person intending to purchase goods acts as a legal entity or within the scope of business or independent professional activity.

1.3 Deviating provisions may be agreed in the Purchase Agreement and will take precedence over these Terms and Conditions.

1.4 The Terms and Conditions are an integral part of the Purchase Agreement. Both the Purchase Agreement and the Terms and Conditions are drafted in Czech.

1.5 The Seller may modify or supplement the Terms and Conditions. Rights and obligations arising during the validity of a previous version remain unaffected.

2. User Account

2.1 By registering on the website, the Buyer gains access to a user account (hereinafter "User Account") to order goods. Ordering may also be possible without registration, if the Web Store Interface allows.

2.2 The Buyer must provide accurate information during registration and when ordering goods and update any changes. Information provided is deemed correct by the Seller.

2.3 Access to the User Account is protected by a username and password. The Buyer must maintain confidentiality of these credentials.

2.4 The Buyer may not allow third parties to use the User Account.

2.5 The Seller may cancel the User Account if it is unused for a prolonged period or if the Buyer breaches the Purchase Agreement or Terms and Conditions.

2.6 The Buyer acknowledges that the User Account may not be available continuously due to maintenance or third-party services.

3. Conclusion of Purchase Agreement

3.1 Product presentation on the Web Store Interface is for informational purposes; the Seller is not obliged to conclude a Purchase Agreement for such goods.

3.2 The Web Store Interface includes information on products, including prices and shipping costs. Prices include VAT and related fees.

3.3 Shipping costs displayed apply only for deliveries within the Czech Republic.

3.4 To order, the Buyer completes the order form, including:

  • ordered goods (added to the electronic shopping cart),

  • payment method and delivery method,

  • information about shipping costs (collectively "Order").

3.5 Before submission, the Buyer can review and modify the Order. Submission occurs by clicking "Complete Order." Receipt is confirmed by the Seller via email.

3.6 The Seller may request additional confirmation of the Order (e.g., in writing or by phone).

3.7 A contractual relationship arises upon acceptance of the Order, confirmed by the Seller via email.

3.8 The Buyer agrees to use remote communication means, bearing related costs themselves.

4. Price and Payment Terms

4.1 Payment methods:

  • cash on delivery;

  • bank transfer to account No. 670100-2214629698/6210 at MBank;

  • payment by card.

4.2 Payment includes delivery costs unless stated otherwise.

4.3 No advance payment is required, except where the Seller requests full payment before dispatch.

4.4 Payment on delivery is due upon receipt; otherwise, within 5 days from conclusion of the Purchase Agreement.

4.5 Bank transfer payments must indicate the variable symbol; payment is completed upon crediting the Seller's account.

4.6 Discounts may not be combined.

4.7 The Seller may issue invoices and receipts in accordance with applicable laws. The Seller is not a VAT payer.

5. Withdrawal from Purchase Agreement

5.1 Certain goods (customized, perishable, mixed, hygiene-related, media/software with opened packaging) are not returnable under § 1837 of the Civil Code.

5.2 Otherwise, the Buyer may withdraw within 14 days from receipt. The withdrawal form may be used and sent by post or email (cistapohovka@gmail.com).

5.3 The Buyer bears return shipping costs.

5.4 Refunds will be made within 14 days using the same payment method.

5.5 Compensation for damage may be offset against the refund.

5.6 The Seller may also withdraw before delivery, refunding the purchase price immediately.

5.7 Gifts provided with goods must also be returned upon withdrawal.

6. Shipping and Delivery

6.1 If shipping is by Buyer's special request, the Buyer bears risk and additional costs.

6.2 The Buyer must accept delivery.

6.3 Additional delivery attempts or methods are at Buyer's expense.

6.4 The Buyer must check packaging on receipt and report any damage to the carrier immediately.

6.5 Further rights may be governed by special delivery conditions issued by the Seller.

7. Rights from Defective Performance

7.1 Rights are governed by the Civil Code (§ 1914–1925, § 2099–2117, § 2161–2174) and the Consumer Protection Act.

7.2 The Seller guarantees goods are free from defects upon delivery:

  • proper properties and quantity,

  • fit for intended purpose,

  • quality or design matching sample,

  • compliance with legal requirements.

7.3–7.6 Exceptions apply to discounted, used, or normally worn goods.

7.7 Further rights may be regulated by the Seller's complaint procedure.

8. Other Rights and Obligations

8.1 Ownership passes upon full payment.

8.2 The Seller is not bound by any codes of conduct.

8.3 Complaints are handled via cistapohovka@gmail.com.

8.4–8.5 Alternative dispute resolution and European consumer centers information.

8.6 The Seller is licensed to sell goods; oversight by relevant authorities applies.

8.7 The Buyer bears the risk of changed circumstances under § 1765(2).

9. Personal Data Protection

9.1 Information obligations under GDPR are fulfilled via a separate document.

10. Marketing Communications and Cookies

10.1 The Buyer consents to receiving commercial communications and information about cookies.

10.2 Consent may be withdrawn at any time if possible.

11. Delivery

11.1 Deliveries may be made to the Buyer's email address.

12. Final Provisions

12.1 Contracts with international elements are governed by Czech law.

12.2 Consumer protection rights remain unaffected.

12.3 Invalid provisions are replaced by provisions with the closest meaning.

12.4 The Purchase Agreement and Terms are archived electronically.

12.5 A withdrawal form is attached as an appendix.
